This SomCentre ratings and reviews terms and conditions govern your conduct associated with written online ratings reviews or Video software recording reviews. These terms supplement other online policies but if there is a conflict, terms of use shall control with respect to SomCentre ratings and reviews. SomnoMed is not responsible for, and disclaims all liability arising out of, any content posted by you or any third party.<\/p>

By submitting any content to SomnoMed, you represent and warrant that:<\/p>

  • you are the sole author and owner of the intellectual property rights thereto;<\/li>
  • all “moral rights” that you may have in such content have been voluntarily waived by you;<\/li>
  • all content that you post is accurate;<\/li>
  • you are at least 18 years old; and<\/li>
  • use of the content you supply does not violate these Terms of Use and will not cause injury to any person or entity.<\/li><\/ul>

    You further agree and warrant that you shall not submit any content:<\/p>

      You agree to indemnify and hold SomnoMed (and its officers, directors,\u00a0 subsidiaries, employees and third-party service providers), harmless from all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown including reasonable attorneys’ fees, arising out of a breach of your representations and warranties set forth above, or your violation of any law or the rights of a third party.<\/p>

      For any content that you submit, you grant SomnoMed a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and\/or sell and\/or distribute such content and\/or incorporate such content into any form, medium or technology throughout the world without compensation or notice to or approval by you.\u00a0Without limiting the foregoing, this grant expressly includes use of such content in whole or part (including your user name) by SomnoMed for any and all advertising and promotional purposes.<\/p>

      All content that you submit may be used at SomnoMed’s sole discretion. SomnoMed reserves the right to change, condense or delete any content on its website that SomnoMed deems, in its sole discretion, to violate the content guidelines or any other provision of these Terms of Use. SomnoMed does not guarantee that you will have any recourse through SomnoMed or otherwise to edit or delete any content you have submitted. SomnoMed reserves the right to remove or to refuse to post any submission for any reason. You acknowledge that you, not SomnoMed, are responsible for the contents of your submission.
