CCPA<\/strong> and\/or CPRA<\/strong> refers to California Consumer Privacy Act (the \u201cCCPA\u201d) as amended by the California Privacy Rights Act of 2020 (the \u201cCPRA\u201d) California Civil Code \u00a7\u00a7 1798.100 \u2013 1798.199.100 & subsequent amendments. Company<\/strong> (referred to as either \u201cthe Company\u201d, \u201cWe\u201d, \u201cUs\u201d or \u201cOur\u201d in this Agreement) refers to SomnoMed, Inc. 6513 Windcrest Drive, STE 100, Plano, TX 75074. For the purpose of the GDPR, the Company is the Data Controller.<\/span><\/p>

Consumer<\/strong>, for the purpose of the CCPA\/CPRA, means a natural person who is a California resident. For the purpose of TDPSA, Consumer means a natural person who is a Texas resident. A resident, as defined in the law, includes (1) every individual who is in the USA for other than a temporary or transitory purpose, and (2) every individual who is domiciled in the USA who is outside the USA for a temporary or transitory purpose.<\/span><\/p>

Cookies<\/strong> are small files that are placed on Your computer, mobile Device, or any other Device by a website, containing the details of Your browsing history on that website among its many uses.<\/span><\/p>

Country<\/strong> refers to the United States.<\/span><\/p>

Data Controller<\/strong>, for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal person who, alone or jointly with others, determines the purposes and means of the processing of Personal Data.<\/span><\/p>

Device<\/strong> means any device that can access the Service such as a computer, a cellphone, or a digital tablet.<\/span><\/p>

Do Not Track<\/strong> (DNT) is a concept that has been promoted by US regulatory authorities, in particular the U.S. Federal Trade Commission (FTC), for the Internet industry to develop and implement a mechanism for allowing internet users to control the tracking of their online activities across websites.<\/span><\/p>

For the purposes of the CCPA\/CPRA, TDPSA, \u201cPersonal Data\u201d means any information that identifies, relates to, describes or is capable of being associated with, or could reasonably be linked, directly or indirectly, with You.<\/span><\/p>

Protected Health Information<\/strong> (PHI)<\/strong> Any information about health status, provision of health care, or payment for health care that is created or collected by a Covered Entity (or a Business Associate of a Covered Entity, both as defined in HIPAA), and can be linked to a specific individual.<\/span><\/p>

Service<\/strong> refers to the Application or the Website or both.<\/span><\/p>

Service Provider<\/strong> means any natural or legal person who processes the data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service, or to assist the Company in analyzing how the Service is used. TDPSA refers to Texas Data Privacy and Security Act – <\/strong>Texas Business and Commerce Code, Chapter 541.<\/span><\/p>

2.0 Collecting and Using Your Personal Data<\/strong><\/span><\/h3>

2.1.1 Personal Data – Protected Health Information (PHI)<\/span><\/span><\/h3>

We use Your data to create and manage Your account for the Service as well as to provide You, Your Sleep Physician and Sleep Dentist with objective data on Your sleep, so they can monitor and improve Your therapy. Examples of PHI collected include physiological and biometric sleep-monitoring data and sleep usage data through the Application.<\/span><\/p>

2.1.2 Personal Data – Personal Identification Information (PII)<\/span><\/strong><\/p>
